Patents
Protecting the way your invention works, typically for up to 20 years.
When you’re granted a patent, you get the exclusive right to decide who can (and can’t) make, use, or sell your invention. Think of it as a trade-off: in exchange for publicly sharing how your invention works, the government gives you a window of time where you’re the only one who can profit from it.
What is a patent and why is it important?
Discover clear, concise answers to your most common questions about patents and their role in protecting your inventions.
What can be patented?
Protection is generally available for physical devices and machines, manufacturing processes and methods, chemical compositions and formulas, and software and technology (in many jurisdictions).
How long does patent protection last?
Patents are generally valid for twenty years from the initial filing date, provided they pass examination and yearly fees are paid.
Will my patent be granted?
The key requirements are that your invention needs to be new, not an obvious extension of something that already exists, and useful in some practical way. This examination process is done by IP Australia, but we will guide you through every step.
Do I need to keep my invention secret?
You should keep your invention secret before a patent application is filed. Once it has been lodged at the patent office you are free to make, use and sell your product.
Why Do Patents Matter?
At their core, patents exist to reward creativity and innovation. They give inventors and businesses the peace of mind to invest in new ideas, knowing that a competitor can’t simply copy their work the moment it hits the market. Beyond protection, a patent can also be a serious business asset, one that can be licensed, sold, or used to attract investors.
Where do I begin?
A Provisional Patent Application is typically the first step and should be done as early as possible. This sets your “priority date” and provides you with 12 months of international protection.
I have a new idea. Where to start?
There are a few options related to patent protection depending on the stage of your invention and whether you want to protect it or are worried about someone else already having a patent.

Freedom to Operate Search
If you have a new product or idea you might be worried that someone else already has a patent. Before spending money on further development or tooling for manufacturing, for example, we can conduct searches to assess the risk from competitor patents, potentially saving you significant money or legal problems in the future.

File a Patent Application
You have an invention and are ready to go public. It is essential that before you do, you get that initial application filed at the patent office so that your “priority date” is set.

Patent Enforcement
Once you have patent protection, it is up to you to enforce your rights effectively. If you discover someone else selling a similar product, for example, we can take you through the available remedies.
